Terms of Service

1. Agreement to Terms

By accessing or using Appointly at appointlyuk.app ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Appointly is a booking management platform that enables service providers (such as nail technicians, barbers, and beauty professionals) to:

• Manage their appointment calendar and availability
• Accept bookings from customers via a public booking page
• Send automated SMS and email reminders
• Collect deposits for bookings
• Manage Instagram direct messages (Social Inbox feature)

3. User Accounts

Service Providers

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account
• You must be at least 18 years old to create a service provider account
• You are responsible for all activity that occurs under your account

Customers

• Customers do not need to create an account to make bookings
• Customers must provide accurate contact information for booking confirmations

4. Instagram Integration

When you connect your Instagram Business account to Appointly:

• You authorize us to access and display your Instagram direct messages
• You authorize us to send replies on your behalf when you use the inbox feature
• You confirm you have the right to connect the Instagram account
• You agree to comply with Instagram's Terms of Service and Community Guidelines
• You can disconnect your Instagram account at any time

We are not responsible for any actions taken by Instagram/Meta, including suspension of your account or changes to their API.

5. Payments and Subscriptions

• Service providers may choose paid subscription plans
• Payments are processed securely through Stripe
• Subscriptions renew automatically unless cancelled
• Refunds are provided in accordance with our refund policy
• Deposit payments collected from customers are processed via Stripe Connect

6. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Send spam or unsolicited messages
• Impersonate others or provide false information
• Attempt to gain unauthorized access to the Service
• Use automated tools to scrape or extract data
• Interfere with the proper functioning of the Service
• Use the Instagram integration to violate Instagram's terms

7. SMS and Email Communications

By using Appointly, service providers authorize us to send SMS and email communications on their behalf to customers for:

• Booking confirmations
• Appointment reminders
• Cancellation and rescheduling notifications

Customers can opt out of SMS messages by replying STOP. Service providers are responsible for ensuring they have appropriate consent to contact their customers.

8. Intellectual Property

The Appointly name, logo, and all related content are owned by us. You may not use our branding without permission. Content you create (business information, services) remains yours.

9. Limitation of Liability

Appointly is provided "as is" without warranties of any kind. We are not liable for:

• Service interruptions or downtime
• Lost bookings or revenue due to technical issues
• Actions taken by third-party services (Stripe, Instagram, SMS providers)
• Disputes between service providers and their customers

Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

You may close your account at any time. We may suspend or terminate accounts that violate these terms or for any other reason with notice. Upon termination:

• Your access to the Service will be revoked
• Your data will be deleted in accordance with our Privacy Policy
• Connected services (Instagram, Stripe) will be disconnected

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the new terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.
